Should a contributor's consent to be contacted have been obtained prior to uploading their contact details to the platform?
Answer
Yes.
Although for many production companies obtaining an individual’s specific consent for this purpose may not be a legal obligation under relevant privacy laws, as part of our 'best practice' approach to protecting individual's privacy we want to ensure everyone is fully informed and consenting at every step.
There are two, complimentary, parts to this:
1. Encouraging contributors to take part by explaining the initiative as suggested here.
2. Ensuring your documentation (e.g. employment contract) records each individual's consent to be contacted.
Sample language for use (if not already addressed in your contract/release form templates):
[Performer/Crew member] consents to their name, position on the production and email address (or mobile number if no email) being provided to The Everyone Project, and the use of that information to contact them and encourage them to participate in a voluntary demographic survey.
This only relates to consent to be contacted by the platform. Further consents are sought directly by the platform as described here.
